By downloading or using Lucky 3, you agree to these terms. If you don't agree, don't use the app.
You must be at least 13 years old to use Lucky 3.
Lucky 3 displays 3 random photos from your device's photo library each day. The app is free and supported by sponsors. The app runs on your device and does not upload your photos. We do not require accounts.
Lucky 3 uses on-device machine learning to analyze your photos locally. This helps surface relevant memories. No photos or analysis data is transmitted.
We may remotely update app configuration, including sponsor content and required app versions, without requiring an app store update. We may require you to update to continue using the app.
You may opt in to daily reminder notifications. You can disable notifications at any time through the app or device settings.
The app displays sponsor attributions. Sponsor content may change and is provided by third parties. We are not responsible for sponsor products, services, websites, or any transactions between you and sponsors. Any interaction with sponsors is at your own risk. We do not endorse, warrant, or guarantee any sponsor products or services.
Your photos stay on your device. We never see, upload, or store your photos.
We grant you a personal, non-commercial, non-exclusive, non-transferable, revocable license to use Lucky 3 on devices you own or control, subject to these terms and the usage rules of the App Store.
If you downloaded Lucky 3 from Apple's App Store, you acknowledge that these terms are between you and Lucky 3 only, not with Apple. Apple has no obligation to provide maintenance, support, or warranty for the app. Apple is not responsible for any claims related to the app, including product liability, legal compliance, or intellectual property. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and you are not on any U.S. Government prohibited or restricted party list.

Lucky 3, including its name, logo, design, and code, is owned by us and protected by copyright and trademark laws. Your photos remain yours — we claim no rights to them.
You acknowledge that Lucky 3 displays photos from your personal photo library, which may include images that evoke strong emotions or memories. You assume all risks associated with viewing your own photos, including any emotional or psychological impact. We are not responsible for the content of your photos or your reaction to them. Lucky 3 is not a therapeutic, medical, or mental health tool.
The following applies only to Lucky 3 React, not the main Lucky 3 app.
Lucky 3 React accesses your camera and microphone to record your face and audio while you view photos. By using this feature, you consent to being recorded. The recording is saved to your Camera Roll and never leaves your device. You assume all risks associated with recording yourself, including how you choose to share that recording. We are not responsible for your recording or any use of it.
To the maximum extent permitted by applicable law, Lucky 3 is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the app will be error-free, secure, uninterrupted, compatible with all devices or iOS versions, or meet your expectations. Use it at your own risk. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Lucky 3, including but not limited to loss of data, loss of profits, or damages resulting from your reliance on the app. Our total aggregate liability for any claims arising from or related to your use of the app is limited to fifty US dollars ($50). Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.
Any claim or cause of action arising from or related to your use of Lucky 3 must be filed within one (1) year after such claim or cause of action arose, or it will be permanently barred. This limitation applies to the maximum extent permitted by applicable law.
To the maximum extent permitted by applicable law, you agree that any disputes will be resolved solely through arbitration for monetary damages, and you waive any right to seek injunctive or other equitable relief against us.
To the maximum extent permitted by applicable law, you release Lucky 3 and its creators, officers, employees, and agents from all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with your use of the app. If you are a California resident, you waive California Civil Code Section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
Lucky 3 relies on third-party services including Apple's iOS platform, Firebase, and the App Store. We are not responsible for the availability, accuracy, or reliability of these third-party services. Your use of these services is subject to their respective terms and privacy policies.
We are not liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemic, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Lucky 3 and its creators, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the app, (b) your violation of these terms, or (c) your violation of any third-party rights. This indemnification obligation will survive termination of these terms and your use of the app.
Informal Resolution First: Before filing any claim, you agree to contact us at hi@lucky3.me and attempt to resolve the dispute informally for at least 30 days.
Binding Arbitration: If we cannot resolve a dispute informally, you and Lucky 3 agree to resolve any claims through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in King County, Washington, USA, unless the AAA Consumer Rules provide otherwise or the parties mutually agree to a different location. Arbitration will be conducted in English, and the arbitrator's decision will be enforceable in any court. You and Lucky 3 agree that any arbitration will be conducted on an individual basis and not as a class, consolidated, or representative action.
Small Claims Exception: Either party may bring an individual action in small claims court instead of arbitration, provided the claim qualifies and remains in small claims court.
Class Action Waiver: You waive any right to participate in a class action lawsuit or class-wide arbitration against us. This waiver applies to the maximum extent permitted by applicable law.
Opt-Out: You may opt out of this arbitration agreement by emailing hi@lucky3.me within 30 days of first using the app with the subject line "Arbitration Opt-Out" and your name. If you opt out, you may pursue claims in court, but the class action waiver still applies to the extent permitted by law.
We may update these terms from time to time. If we make material changes, we will notify you through the app or by updating the "Last Updated" date on this page. Your continued use of Lucky 3 after any changes constitutes acceptance of the new terms. If you do not agree to the updated terms, you should stop using the app.
You can stop using Lucky 3 at any time by deleting the app. We may discontinue the app or restrict access if you violate these terms.
We may assign or transfer these terms, and our rights and obligations, to any third party in connection with a merger, acquisition, reorganization, or sale of assets, or by operation of law. We will make reasonable efforts to notify you of any such assignment through the app or website. You may not assign or transfer your rights under these terms without our prior written consent.
Lucky 3 is operated from the United States. If you access the app from outside the United States, you do so at your own initiative and are responsible for compliance with local laws. For users in the European Economic Area (EEA), United Kingdom, or Switzerland: nothing in these terms affects your statutory rights as a consumer under applicable local law that cannot be waived by contract. If any provision of these terms conflicts with mandatory consumer protection laws in your jurisdiction, that provision will be modified to the minimum extent necessary to comply with such laws.
These terms are governed by the laws of the State of Washington, USA, without regard to conflict of law principles. For any disputes not subject to arbitration, you consent to the exclusive jurisdiction and venue of the state and federal courts located in King County, Washington. However, if you are a consumer in the EEA, UK, or Switzerland, you may also benefit from mandatory provisions of the law of the country where you reside.
If any provision of these terms is found unenforceable, the remaining provisions will continue in effect. If any provision is found to be overly broad, that provision shall be modified to the minimum extent necessary to make it enforceable.
Our failure to enforce any right or provision of these terms will not be considered a waiver of that right or provision. Any waiver must be in writing and signed by us to be effective.
These terms constitute the entire agreement between you and Lucky 3 regarding use of the app.
